LDWA Website Terms of Use

The LDWA website is provided by the Long Distance Walkers Association Limited ('LDWA'), a company limited by guarantee and registered in the UK. The website includes information about various products and services provided by the LDWA and others ('Services').

In using this website and other sites in the ldwa.org.uk/ family of sites you agree to these Terms and Conditions of Use, as they are amended from time to time. If you do not wish to be bound by these Terms and Conditions you must cease to use the sites. If you are using the Services on behalf of a business, that business accepts these terms.

We keep all our services under review and may add or remove functions or may suspend or cease any part of the Services without notice.

This website does not attempt to provide advice on safety aspects of walking. There are inherent risks in any outdoor activity, and walkers should note the specific safety advice.

Material displayed on this site that is User Generated Content remains the property of the contributors; all other material displayed on this site is the property of the LDWA.

Some information on this LDWA website is the copyright of a third party, the LDWA either hold an explicit or implied license to use this material. If you want to use this material you will need to obtain your own consent from the LDWA or original copyright holder for its use in your media. If you consider we have used your copyright material without your consent and you wish us to remove it, please Contact Us indicating the reference.

All source code, scripts, database functionality and other material which forms this website is subject to property and copyright controls.

User Generated Content
(Social Walk Database and Long Distance Path Database)

The Long Distance Path and Social Walks database allows you to share routes, information, data, photographs, comments and other content. Such content is referred to as User Generated Content.

Please note that your route maps will only be available to members, whereas all other User Generated Content will be publicly accessible by all users on the LDWA website.

Please ensure that you either own or have appropriate permission to share any User Generated Content before doing so.

If you create or contribute User Generated Content, you must NOT include any of the following (Restricted Content):

  • material which is illegal or promotes illegality;
  • misleading information;
  • material which is likely to cause harm to others;
  • material which is threatening, abusive, offensive or indecent;
  • defamatory material;
  • material which infringes copyright or any other intellectual property rights of a third party;
  • advertisements;
  • personal information about you or a third party; or
  • material which contains a virus or other harmful component.

We do not claim any ownership of any intellectual property rights which arise/subsist in your User Generated Content. However you grant us a royalty-free, worldwide, non-exclusive, perpetual licence to use User Generated Content and to use, store, reproduce, make derivative works of, and make your User Generated Content available to third parties, for any other purpose. (You agree to waive any moral rights subsisting in your User Generated Content).

You will be responsible to us for any losses, expenses or other costs incurred by us which are caused by you deliberately contributing any Restricted Content to the Long Distance Path or Social Walk Database.

Where permissible by law, we may disclose your identity and any other necessary information to any third party who claims that any User Generated Content submitted by you constitutes a violation of their intellectual property or other legal rights.

Social Walk and Long Distance Path Web Pages

Inclusion of a social walk or long distance path route is in no way an indication of its quality in terms of scenery, attraction, usability or safety. Whilst care has been taken to include routes that are on rights of way, or paths or access areas where permission exists, inclusion of a route is no evidence of a current right of way or permissive access.

LDWA Members Area

The LDWA website, forum and associated mailing functions are provided as part of the organisation’s platform to provide communication systems, allowing you to connect more easily with members throughout LDWA and to provide access to useful sources of information.

Important points to remember:

Legislation and Policies

  • When you use the service you are bound by LDWA policies, such as Safeguarding and Acceptable Use, and you are also bound by any relevant legislation, such as Data Protection and Copyright laws.
  • Don’t share content that you don’t have legal permission to use.
  • All use of the website should be related to the business of LDWA. Any use for personal or commercial gain, or advertising of products or events unrelated to LDWA is prohibited.

Sharing Content

  • Use of the forums and mailing helps build communities of practice and connections; this requires that everyone follows the simple community rules so that everyone can benefit from this service:
    • Do not use strong language, terms and expressions that may offend others.
    • Be respectful. Make sure your posts are appropriate and aimed at the right audiences. Online comments can be easily misconstrued.
    • Don’t post images or content that are likely to cause harm or offence to others.
    • Personal attacks are not acceptable. One to one arguments, disagreements and disputes of a personal nature must not be conducted through LDWA services.
    • Be appropriate. Don’t spam forums or post messages that are unrelated to the purpose of that forum. Post questions to appropriate Forums.

Security

  • Be aware. Make sure you protect your and others privacy. Don’t share personal details, yours or anyone else’s.
  • Be secure. Don't share your individual membership password and family/affiliates do not share outside of your family/affiliation. Make sure you have a strong password.
  • Your Membership Details are for your use only - do not reveal your password to anyone else, or allow anyone else to use your details.

Misuse

  • Misuse of services will be reported the LDWA. LDWA may use system analytics to measure the general use of the website. LDWA reserves the right to monitor compliance with this code.
  • If you see any postings that you feel breach the letter or spirit of these rules then please contact internet@ldwa.org.uk with details.

External Suppliers

In providing the Services, we use or provide links to third party suppliers. Once you have transferred to the third party website you become a customer of the third party and you cease to have a relationship with LDWA. Your transaction is then with the third party and any funds you provide go to the third party. The LDWA has no liability if you are not satisfied with the services from the third party.

The LDWA may receive commission on your completed purchases where we have such an arrangement with a supplier (an Affiliate or referral arrangement), but any commission is paid to LDWA only after clearance of your payments and is a separate transaction between LDWA and the Affiliate provider.

LDWA Shop – Payment Details

Although we accept Membership Renewals and Shop Purchases by credit or debit card we never store the card details. For additional security we do not process any debit or credit card transactions but instead use a dedicated payment service provider called Stripe.

Liability Limitations and Governing Law

The LDWA has used reasonable endeavours to ensure the accuracy of the information contained within this web site, and reserves the right to revise, update or make obsolete some or all of the contents without obligation to notify any person of such changes. Despite every effort to the contrary, errors, omissions or discrepancies may have occurred in preparation of these documents, and the LDWA assumes no liability for loss or damages incurred due in part or in whole to such errors.

We use reasonable endeavours in providing our Services. We do not make any specific promises about the Services, including their content, the specific functions of the Services or their reliability, availability or ability to meet your needs. To the extent permitted by law, the total liability of LDWA and its suppliers and distributors to you for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use the Services. In all cases, LDWA will not be liable for any loss or damage that is not reasonably foreseeable.

Any disputes under these terms will be governed by and settled under the Laws of England and Wales.
